Why Are Patent Laws Important?

Bookmark and Share

A patent is an intellectual property right granted to an inventor for his invention and also for the manufacturing process for creating that product or invention. It plays a very important part in the world of commerce by encouraging novel ideas and inventions.

When an inventor invents an innovative and exclusive product that can be marketed for a profit, he would not want anyone else to take benefit of his creation, and the time and energy invested in it. However, it is not easy to watch over each and every violation of your right over your creation as you might be required to talk about it in public for marketing purposes. It is here that patent laws step into the picture.

Patent laws allow the inventor to make exclusive use of the invention or the manufacturing process for a stipulated period and then permit the product or process to pass into the pubic domain where it can be accessed by anyone for any purpose. This allows the inventor to get significant returns on his efforts in a lawful manner and also to prosecute any person who is found infringing his rights over the product or the process.

Another aspect that adds to the significance of patents is that they help the inventor license out his invention for a good return, as most licensees are interested in exclusive rights over a product. However, the complex procedures and high costs involved in patenting make it unnecessary for products with low commercial demand as well as for those which are to be marketed for a very limited time span.

Patents are most important in a situation where the product, which has been created through hard work and skills of an individual or a group, has fair potential in the market due to some unique benefit that it offers. Had such investments in terms of time and efforts not been given legal protection, there would have been no real benefit for people to come up with novel ideas and inventions.
